Terms and Conditions for Canvas Landscaping
Welcome to Canvas Landscaping! These Terms and Conditions govern your use of the services provided by Canvas Landscaping. By accessing or using our services, you agree to comply with and be bound by these terms. If you do not agree with any part of these terms, you must not use our services.
1. Acceptance of Terms
By engaging Canvas Landscaping for any residential or commercial landscaping and lawn care services, including but not limited to lawn maintenance, landscape construction, property cleanup, yard enhancement, and outdoor space improvement, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. These terms apply to all visitors, users, and others who access or use our services.
2. Services Provided
Canvas Landscaping offers a variety of outdoor property services including:
- Lawn Maintenance (mowing, edging, blowing)
- Landscape Design and Installation
- Hardscaping (patios, walkways, retaining walls)
- Property Cleanup and Debris Removal
- Seasonal Yard Services (spring cleanups, fall leaf removal)
- Turf Care and Garden Maintenance
- Other customized outdoor space improvement solutions
All services will be performed with attention to detail and a commitment to quality, tailored to the client's specific needs and property characteristics in the Starke, Florida region.
3. Client Responsibilities
Clients are responsible for:
- Providing clear and safe access to the service areas.
- Ensuring the service area is free from pet waste, toys, or other obstacles prior to our arrival.
- Notifying Canvas Landscaping of any underground utilities, irrigation systems, or other hidden structures that could be damaged during service.
- Prompt payment for services rendered as per agreed terms.
- Communicating any concerns or special requests in a timely manner.
4. Pricing and Payments
Service pricing will be provided through a detailed estimate or proposal, based on the scope of work. Payment terms will be clearly outlined in the service agreement. Unless otherwise specified, full payment is due upon completion of services. For larger projects, a deposit may be required, and progress payments may be scheduled. We reserve the right to charge late fees on overdue accounts.
All prices are subject to change with prior notice. Estimates are valid for a specified period as indicated on the estimate document.
5. Cancellations and Rescheduling
Clients are requested to provide at least 24 hours' notice for any service cancellation or rescheduling. Failure to do so may result in a cancellation fee. Canvas Landscaping reserves the right to reschedule services due to inclement weather, equipment failure, or unforeseen circumstances, with reasonable notice to the client.
6. Warranty and Guarantees
Canvas Landscaping stands by the quality of our work. Any specific warranties for plants, materials, or hardscape elements will be explicitly stated in your service agreement. We commit to addressing any issues arising directly from our workmanship within a reasonable timeframe, provided the client notifies us promptly.
7. Limitation of Liability
Canvas Landscaping will exercise reasonable care and skill in performing all services. However, we are not responsible for damage caused by pre-existing conditions, issues beyond our control (e.g., severe weather, pest infestations not addressed by our service), or damages occurring due to a client's failure to notify us of critical information (e.g., unmarked irrigation lines). Our liability for any damage to property or persons shall be limited to the cost of rectifying the damage or the total value of the service provided, whichever is less.
8. Intellectual Property
Any landscape designs, plans, or visual materials created by Canvas Landscaping within the scope of our services remain the intellectual property of Canvas Landscaping until full payment for the associated design services is received. Upon full payment, the client is granted a license for the use of the design for their property.
9. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
10. Changes to Terms
Canvas Landscaping reserves the right to modify or replace these Terms and Conditions at any time. We will provide reasonable notice of any significant changes. Your continued use of our services after any such changes constitutes your acceptance of the new Terms and Conditions.
